Please note that your California Privacy Rights are included in Section 9 Below This Privacy Policy (the “Policy”) explains the information Duggal Visual Solutions, Inc. (“Duggal”) collects about users of floorgraphicsandmore.com (the “Site”) and how we share this information with third parties. By accessing and using this Site you agree to this Policy. If you do not agree to the Policies stated below, please immediately exit the Site. Your right to use this Site is conditioned on your acceptance of both the Policy and the Terms of Use.

1. Scope Of This Policy

This Policy applies only to information collected when you visit the Site. If you visit other websites operated by Duggal or our affiliated companies or websites operated by third parties, the privacy policy from that website will apply. In particular, this Policy addresses how we collect, use and share “Personally Identifiable Information” (“PII”) when you visit the Site. We also explain how we use Non-PII and aggregated data. This Policy does not apply to any information we may collect about you based on off line contact we may have with you or information we may collect about you from other sites including, for instance, Facebook or other social media sites. Please see Section 9 below where we discuss the types of information we collect and share if you access our content on a social media website or application.

PII refers to information that is collected via the Internet that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. It covers such items as your social security number, your driver’s license number, your email, address, telephone, bank accounts, and other financial accounts. It also includes any other information that is then related to your online identify including but not limited to such things as your Facebook likes and friend list, your brand preferences, or your most recent transactions or browsing history. For instance, if you click on one of emails or on a banner advertisement for the Site anywhere on the Internet we will use that information to identify the IP address of your computer and mobile device and link to the PII we have about you.

Non-PII refers to all other information we may collect about visitors to the Site who are otherwise unknown to us including such things as how they navigate through the Site, what website they were on immediately before accessing the Site or what website they navigate to when they leave the Site. It also collects information about what browser you use and similar technical data.

2. Duggal Reserves Its Right To Change This Policy At Any Time For Any Reason

This Policy is current as of the date listed at the top of this page. We may modify or alter sections of this Policy or add in new provisions in our sole discretion without notice to you. The Policy in effect at the time you visit the Site governs how we collect and use PII we collect during that visit. Any changes in the Policy will only be applied prospectively. When we do make any changes to this Policy we will update the date appearing at the top of this webpage. You acknowledge that it is your responsibility to check this webpage periodically to ensure you understand how we collect and use any information we collect from visitors to the Site.

3. The PII We Collect When You Visit the Site.

A. Registration.

In order to place an order on the Site you will be required to register and create a user name and password. During the registration process you will provide us with you name, postal address, telephone number, email address, and credit card information.

B. Financial information.

Please note that the credit card or other financial information you may use to pay for your purchases are not handled by floorgraphicsandmore.com or Duggal. We offer two payment alternatives: Authorize.net and Paypal.com. Once you begin the payment process your transaction is processed on their respective servers and we do not have access to or store this information on our servers or in our database. Authoize.net provides a useful explanation to payment processing via the web that can be accessed here.You should also review Authorize.net terms of use and its privacy policy, If you elect to use PayPal.com you should review its terms of use and its privacy policy.

You acknowledge that floorgraphicsandmore.com and Duggal are not responsible for any violation by either Authorize.net or PayPal.com in conforming to their respective policies. Under no circumstances will ShopDugal or Duggal be responsible for any data breach of theft of your financial data that may arise because of your use of their services.


C. Your Purchases on the Site

Once you have registered on the Site we track the products you view and purchase including the sizes, colors, and styles you may select and will combine this information with your PII.

D. Newsletters or Email Alerts

Even if you do not register on the Site you may still sign up for a floorgraphicsandmore.com newsletter and/or email alerts about new products, discounts, or sales. When you sign up for either we will collect your name and email address. If you click on any of the links in an email from us we will also use that information to match the IP address on your computer. In this way even when you visit the Site without logging in we will be able to identify you and track your use of the Site.

E. Banner Advertisements and Online Advertising

The Site does not have any advertisements by third parties. However, Shop Duggal does place advertisements on other sites If you click on one or our advertisements or “buttons” on other sites, we will have access to certain information about your computer, browser, what website you were on when you clicked on our advertisement, and similar information. If you actually visit the Site after clicking on our advertisement on another website we will combine whatever information we collected before then with any information we may collect while you are on the Site. In this way we will be able to identify you and track your use of the Site even if you do not log in. We may also share this information in aggregated form with different advertising platforms to help serve you advertisements across the Internet that will be most relevant to you.

You may opt out of having this information used to deliver advertisements to you based on the information collected by you by these advertising platform by following this link. You will also find information about behavioral or interest based advertising in general and how different platforms use this information.. Please note that even if you opt out you will continue to see advertisements but they will randomly selected.

F. Other Information Collected When You Visit The Site

We also collect information about visitors to the Site in aggregate form concerning how you navigate through the Site, which website you were at before visiting our Site, and which website you go to once you leave the Site. If you have registered on the Site or signed up for a newsletter or email alert we may also combine all this information into you your individual profile.

4. How Do We Collect This Information Including PII?

7. Do We Share Your PII With Any Third Parties?

A. Our Partners or Vendors
We share the PII we collect with our partners or vendors who are involved in fulfilling your order or otherwise servicing your account. However, these partners and vendors are contractually obligated to only use this PII in connection with the specific task they have been asked to complete and to not make any other use of your PII for any reason.

B. Our Affiliates and Related Companies

We also share any information we collect about you with YourArtGallery.com. and Duggal.com. However, Duggal.com and YourArtGallery.com do not share this information with any third parties except vendors who assist them with their marketing and promotional activities or with website maintenance. These vendors are contractually obligated to not use this information except as directed by our affiliates.

C. Other Third Parties

We do not sell, trade, or otherwise transfer PII to third parties except as provided above unless we provide you with advance notice at the time we collect the PII. We may also share PII collected from the Site in aggregate form with third party advertisers or others for marketing or other purposes.

D. Other Uses of PII

Notwithstanding anything to the contrary in this Policy we reserve our right to use any PII collected via the Site and to share such information with law enforcement or investigators hired by us to investigate any possible misuse of the Site or any possible hacking or attacks on the Site’s security. You understand that our use of your PII under these circumstances will be done without any advance notice and may be used to prove your culpability for violating their Terms governing your use of the Site. Occasionally, at our discretion, we may include or offer third party products or services on our website via a link or similar technologies. . These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites.

9. Special Policies Concerning Social Media

If you access our content via Facebook, Twitter, or any other social media platform (each individually a “Social Media Platform” and collectively referred to as “Social Media Platforms”), you are also authorizing us to share and receive information about you with that Social Media Platform. Each Social Platform has its own privacy policy concerning what information they collect, how they use it, and with whom they will share it. The Site also uses social medial plugins such as Share on Facbook, the Like Button, and the Share To Twitter features. These features allow you to easily share information with others. When you visit our Site, the operator of the social plugin can place a cookie on your computer, enabling that operator to recognize individuals who have previously visited our site. If you are logged into a Social Media Platform while browsing on the Site, the social plugins allow that Social Media Platform to share data about your activities on our Site with other users of their Social Media Platform. For example, Facebook Social Plugins allows Facebook to show your Likes and comments on our Site to your Facebook friends. Facebook Social Plugins also allows you to see your friends’ Facebook activity on our Site. We do not control any of the content from the social media plugins. We are committed to protecting your information. We will respond to such requests to information access within 30 days following receipt at the email or mailing address stated above. If we receive your request at a different email or mailing address, we will respond within a reasonable period of time, but not to exceed 150 days from the date received. Please note that we are only required to respond to each customer once per calendar year.

13. Do Not Track Settings

California law requires that we indicate whether we honor “DO NOT TRACK" settings in your browser. This setting is intended to allow customers who do not to wish to receive communications from third party based on their Internet browsing activity. While you will not find any advertisements at this time on the Site, we do participate in advertising platforms that do engage in this type of activity. Information we collect about you from the Site or otherwise will be shared with various advertising platforms in aggregated form. As explained above in Section 3 D, you may opt out of behavioral based advertising by following the links provided. Therefore, at this time we do not monitor or follow any DO NOT TRACK REQUESTS.

14. Children’s Privacy

Users under the age of 16 are not permitted on this Site. We therefore do not knowingly collect any information about users under the age of 16.
